Late on January 19 a man from Ningbo was arrested for a DUI during a routine road block by traffic police. While other cars lined up to be inspected, a car driven by a Mr. Lee drove for a few meters and then stopped. The police saw this suspicious activity and approached him and made him take a breathalyzer, which he failed miserably. Mr. Lee was given 12 points on his license, had his license suspended for 6 months and was fined 2,000 RMB.
Mr. Lee was very distressed by the whole situation as he explained what actually happened. He said that he had gone to KTV with a few friends and had a couple of beers. At the end of the night he got to his car but realized he was too drunk to drive. So he called a cab and got into his car to be warm while he waited. While he was still waiting a car behind him asked him to move as he was in the way, so Mr. Lee obliged, and that’s when he caught the attention of the traffic police.
The police had no sympathy for Mr. Lee and told him that his actions still constituted drunk driving and that his punishment will be upheld.

In the US, at least in some jurisdictions (according to the show COPS), the standard is sitting in the drivers seat with the keys out. That's enough to prove intent. It kinda sucks because it really doesn't allow for any kind of grey area like with this guy's story. If true, he was behaving responsibly. But even in a true proper country he could be convicted.
