Man Kidnapped by Ex-Girlfriend to Extort Abortion Fee; Court Rules in Girl’s Favor

In China, you really don’t know what way the pendant of justice will swing and this story shows just how murky the line can be.

Last September in Nanchong city, Yingshan County, Sichuan Province, Quan Minxing and Chen Lu quickly began a romantic relationship. Chen abandoned her studies in Chengdu and moved in with Quan. The relationship advanced to the point where Quan’s father was about to arrange a marriage for the two. However, when Chen became pregnant with Quan’s child, her feelings towards Quan changed.

When Chen's former boyfriend Peng Xiaoyu reappeared in her life, Chen finally decided that their relationship was over. On the last day of 2012, Chen stated to Quan that she was pregnant and that she wanted to separate from him. To this, Chen requested 5, 000 Yuan in payment for the abortion as well as a "youth fee" for the time spent with him, which Quan refused to pay. Having been rejected, Chen told Peng that she had been raped and impregnated by Quan after which the two conspired to have Quan kidnapped in order to extort this fee from him.

Using a fruit knife, the two forced Quan to go back to Peng’s place of abode. There, Quan was able to break free of the restraints on his wrists and shouted for help. He then grabbed the knife that was pointed towards his chest and used it against Peng, resulting in Peng suffering a serious chest wound. During Quan’s escape, Chen’s right arm had also received a heavy cut.

The courts decided that the use of force in defending Quan’s own person was excessive and was judged to have been guilty of deliberate intent to harm. On October 25, Quan was sentenced to a suspended sentence of two years.

The court ruled that Chen's request to help pay for the abortion did not constitute a criminal activity, and that their "kidnapping" as well did not constitute any illegal acts.

haha chinas laws are retarded you cant defend yourself while facing death or torture, because if you do so and escape you get punished by the laws. did the judges ever read the story or were they busy with counting money?

Let me get this straight...a guy breaks free from his kidnappers and defends himself and HE gets the suspended jail sentence and HE is in the wrong? Seems to be a lot more to this story than has been revealed I think. OR...it makes sense in China.
