Passenger Fails to Receive Compensation from Uber after Car Accident

A Shenzhen man told reporters yesterday how Uber, the company behind the popular taxi app, is refusing to pay his medical bills of nearly 100,000 Yuan for an injury he sustained while using their service. A statement from Uber claims that the man has yet to provide the necessary documents.

According to the passenger, Mr. Pan, on March 11 last year, he was involved in a car accident when the driver was using his cellphone and rear-ended another car. Pan sustained a right ankle fracture as a result of the accident.

According to Pan, the driver told him that any claims could be processed through Uber, but after months of attempting to contact Uber and manage the situation, Pan eventually only received 9000 Yuan. Pan has been unemployed since the accident and has filed a loss of income claim of 18,000 Yuan per month, proof of which he claims to have already submitted.

An official representative from Uber told reporters that since the accident, the team in Shenzhen had made regular efforts to contact Pan and settle the claims, but he has yet to submit his medical costs or proof of income for his loss of income claim.

well there is a reason why these privately run limo services are in a legal gray area. If you get in a taxi accident you get compensated because the taxi company and taxi has a commercial insurance. They pay a commercial tax. Uber is regular people picking people up, on a private insurance, do not pay tax on their income and the company might not be liable for the driver's action. However people here think they can scam money out of everything. Legally did he inform uber during his travel in the car that the driver is playing with his phone?..well most probably thedude was himself busy looking around for women on his wechat. and how did he break his ankle ??...18000 a month?...lol if he was earning that then he most probably has a car of his own....or what about his tax receipts for 18k a month?...lastly the company cannot fire him because of a medical condition, he should rather be sueing the company maybe its better.

Once I got with a drunk driver using didi da che , he started to drive slowly in the wrong way , I took the chance when he stopped and left the car and I didn't complete the payment , I called didi dache and complained about the drunk driver and they advised me to complete the payment and they will return the money when they check with the driver and result no money is returned and didi dache like any other service here can't take responsibility and would sincerely lie to their customers.

lol...i been in plenty of those...infact once i got picked up y guy high on cocaine ...infact he offered me some...and after a while was so screwed up that i had to drive the car back..asked him to revoke the offer and let him sleep in his car near where i wanted to go... oh btw be careful with those scooty driving service outside bars..especially if you are a foreigner looking for someone to drive your car if you are drunk...some are not legit, and you will be missing a car and maybe your kidney aswell..be careful out there guys...especially girls..

How about asking the driver to pay for compensation? I mean as far as I know, Uber (and Didi too) drivers are independent and only use the app to find passengers. The driver should be held responsible for using his cellphone while driving, not Uber. But hey this is China. If I were, as a Foreigner, to lose a leg in a car crash after I used Didi to book that lift, I would most likely be unable to sue either the driver or the company for compensation, I would even maybe have to apologize on TV for even thinking about it and hurting the feelings of Chinese people. Such a racist country with double standards, and then they wonder why FDI doesn't happen now that they urgently need it since their economy is slowing, the wold is learning. Fool me once shame on you, fool me twice shame on me.

I say my income is 10000000000000 per month, that is my proof. And a fractured ankle which takes about 6 weeks to heal is why I've been out of work for 1 year, 52 weeks. And the driver's insurance gets to sit this one out? Broken ankle from a low speed collision, wasn't wearing a seat belt and wants to benefit from breaking the law. Uber, get out of China. Chinese will line up to cheat, scam and steal from any foreign company that sets foot in China. Then they'll squat and scratch their asses trying to figure out why foreign companies are leaving and their economy is tanking.
