Good Samaritan Loses 2 Year Court Battle Against Unscrupulous Granny

Although this unnecessarily complicated affair regarding an old woman who fell over in a park and blamed the man who tried to help her up is a couple of years old, its sheer ridiculousness (and injustice) is perhaps summed up with the fact it took two years to finally come to an end.

On May 5 2011, 84 year-old grandmother Li was walking with her family in Guangzhou’s Baomo Garden. When they were walking by the water area of the park, a man surnamed Zeng, who was with his wife and four friends, were nearby feeding goldfish. It was then, that Granny Li suddenly fell to the ground and injured herself.

Good Samaritan Zeng was quick to rush over and help her up; however Li claimed that it was Zeng who had pushed her to the ground. Staff and wardens at the park soon arrived on the scene, though due to there being no security cameras nearby, they weren’t sure who to believe. Police then arrived and took Zeng to the police station for questioning, while Li was taken to a nearby hospital.

Hospital staff quickly discovered that Li had fractured her left femur, and after five months, Li eventually lost much of the use of her left hip and was effectively disabled. Li later took Zeng and the authorities of the Baomo Garden to court, and demanded a compensation for economic losses amounting to over 50,000 RMB, as well as damages of another 50,000 RMB.  

During the hearing, the court declared that as there was no video evidence and no eye-witnesses who refuted Li’s claims, so they basically had to come to their own logical conclusions. Zeng reiterated that he did nothing, however made a huge mistake when he stated that Li was in fact leaning against a wall and hadn’t actually fallen down. Upon hearing this, the court was quick to realize the discrepancy in Zeng’s side of the story, as he had originally stated that he had helped lift her up after she had fallen. As determined Li had kept her story (albeit a false one) straight the whole time, the court ended up believing her.

Zeng then appealed against the conviction, though it was recently announced that the Guangzhou Intermediate Court rejected his appeal, and he was made cough up the money.

Thank goodness in America a lack of evidence will always be in the favor of the defendant. You shouldn't be able to prosecute any crime by he says/she says. The least the court could do was reduce the RMB amount in half since neither the defendant or accuser had any evidence. As a human being, I will always help an old lady in distress in fear she needs medical attention, but I can't imagine the rage I will have if they accuse me of a crime and will ensure any friend I am with records the entire event with their camera phone.
