China’s Top Legislature Considering Abolishing Soliciting Underage Prostitutes

China is moving towards banning the crime of soliciting sex from underage prostitutes.

The move would prevent overlap of rape and underage prostitution cases, which carry different sentences and in order to protect the reputations of victims.

As Sun Xiaomei of the All-China Women’s Federation explained, if a man assaults an underage girl, then is charged for soliciting, the underage girl can be then labeled a prostitute.

It hasn’t yet been made clear whether or not sex with underage prostitutes will then be reclassified as assault.

Are they saying under current laws, a man can rape a child but only be charged with soliciting a prostitute. And then the underaged girl gets publicly labeled a prostitute. WTF! By definition an underaged girl can't be a prostitute. She is a sex slave. Children are not legally capable of giving consent. Someone is forcing them, they are being sold not selling themselves. Chinese officials are very smart but seriously morally corrupt. The laws exist the way they are now for the purpose of making it virtually impossible for victims to come forward. And they are only now 'considering' making changes. Here's whats really going on. They are trying to figure out how to create a new deterrent. Raping young women is something they don't want to give up.

I don't think I understood this article clearly... Are they saying that having sex with underage children, as long as solicited, means the child is a prostitute and somehow that makes it all okay? Leave the children alone!

No, they are saying as the law stands at the moment if someone has relations (for a better word) with an underage child it is only classed as soliciting an under age prostitute. They want the law changed to count it as rape

Dear Robk, No, it's not OK. But if the child does the sex 'voluntarily' even though being pushed or maneuvered into the act so she may be under certain conditions considered being prostitute and then for such a crime of having sex with the underage prostitute the punishment is 5-15 years in the jail. However for the rape the current legislation says 3 years - capital punishment. If the final conclusion of the current investigation will be abolishing of child prostitution paragraph so it would most probably result in the fact that any sexual intercourse with underage would be classified as rape.

Poor grammar in the title. You need to add the word "Charge" to the end. I initially read it as meaning "The people in China's top legislative departments are considering not soliciting underage prostitutes any more." Haha, as if they would ever consider that.
