Wuxi Intermediate People’s Court in Jiangsu Province had a difficult task as two sets of grandparents fought over the embryos that their children had hoped to have through artificial insemination before they died in a car crash.

Initially, the court had ruled that the embryos were only to be implanted into Liu Xi, the mother, something which would be impossible following her and her husband’s (Shen Jie) death.

The grandparents took it to the higher courts, fighting for their belief that their children’s property could be inherited by them, and that the embryos were technically their property. As this is a legal grey area, emotions were taken into account and the fact that these embryos were the only way for the two couples’ only children’s genetics and family lineage to carry on.

Although the court agreed, surrogacy is currently illegal in China so the grandparents have more obstacles to face; for now, the embryos are being held by a hospital in the hope that the laws will relax at some point.
