Carpool Driver Forced to Compensate Passenger After Crash

A Yanjiao, Hebei man in charge of a carpool was forced to compensate one of his passengers after she was injured in his car during an accident.

Mr. Che was driving Ms. Li, and three others in a carpool this past June. Che and his passengers were all injured in a car crash. Police reported that the accident was Che's fault.

Li was left with large scars on her face and legs after the accident. She took Che to court, asking for 50,000 Yuan in compensation. Che agreed to pay Li's medical expenses but said he could not compensate her further.

Che drove Li and the other passengers every day from Yanjiao to Beijing for work. Each passenger chipped in 10 Yuan. The day of the accident, police said that Che had violated traffic rules. Che was also supposed to be driving the car for non-commercial purposes, therefore his insurance did not fully cover his accident.

The court found that Li was also at fault as well because she knew that Che was not a commercial driver and chose to ride with him daily anyways. Therefore, the court determined that Li was liable for 20% of her medical costs and Che was responsible for 80% of her medical costs not covered by insurance.

The court stipulated that the insurance company pay the limit of 2400 Yuan for Li's hospitalization, care and lost wages. Che paid 4360 Yuan to Li, and the rest of her expenses came out of her own pocket.
